Whilst some commentators before 23 June highlighted TUPE as a sure-fire candidate for the axe in the event of BREXIT, it is less than certain that once BREXIT is negotiated with the EU that any trade deal will enable more than minor modification.

In 2013 the Department for Business, Innovation and Skills (BIS) consulted on proposed changes to the 2006 Regulations. In its observations BIS said that the regulations "may have imposed unnecessary burdens on businesses" and suggested that the "service provision change" provisions of the regulations should be altered or removed; also the constraints on post-transfer harmonisation of employment terms.

Whether it is a service change or a business sale knowing when and how TUPE impacts is vital to businesses.
In this seminar, we shall:

  • Revisit the rules of the game
  • Review the current state of play in respect of business sales and service provision changes
  • Consider which employees transfer
  • What needs covering on entry and on exit for new outsource service providers and service customers
  • Look at “holding on to the good ones” – alternative roles
  • Suggest contractual techniques to mitigate liability
